1. Agreement Overview

• These terms and conditions govern the hire of mobile carts from Birdy Cart Hire. By hiring a mobile cart from us, you agree to comply with these terms and conditions. Please read them carefully before making a booking.

2. Booking & Reservation

• All bookings must be made in advance through our booking system or by contacting us directly.
• A deposit of 50% is required at the time of booking to secure the reservation.
• The balance of the hire fee is due 5 days before the event date.
• Bookings are subject to availability.

3. Last-Minute Bookings

• A last-minute booking is defined as a reservation made within 2 days of the event date.
• Full payment, including any applicable rush fees, is required at the time of booking for last-minute reservations.

4. Rental Period

• The standard hire period is minimun 1 hour.
• Additional hours will be charged.
• The hire period starts from the agreed-upon delivery time, and any - extension of the rental period must be approved in writing.

5. Delivery & Collection

• Delivery and collection times will be confirmed during the booking process.
• The customer is responsible for ensuring that there is sufficient space and access at the delivery location for the cart. Example: Loading dock.
• If the customer fails to be present at the time of delivery or collection, an additional charge may apply.

6. Use of Mobile Cart

• The mobile cart is for the customer’s use only during the rental period.
• The customer agrees not to modify or alter the cart in any way.
• The customer is responsible for ensuring that the cart is used in accordance with local laws and regulations, including but not limited to health and safety requirements.

7. Customer Responsibilities

• The customer must ensure that the cart is kept in good condition and securely parked when not in use.
• Any damage, loss, or theft of the cart during the hire period will be the responsibility of the customer. The customer will be liable for any repairs or replacement costs.
• The customer is responsible for cleaning the cart after use, unless otherwise agreed. In dry hire situation.

8. Cancellations & Changes

• Cancellations made 14 days before the hire date will incur a full  cancellation fee. Except the printing material fees.
• Cancellations made less than 2 days before the hire date will incur a full fee.
• Changes to the booking, such as alterations to the rental period or delivery time, must be requested at least 7 days in advance and are subject to availability.

9. Indemnity & Liability

• The customer agrees to indemnify and hold harmless Birdy Cart Hire against any claims, damages, losses, or injuries arising from the use of the mobile cart during the hire period.
• Birdy Cart Hire is not responsible for any personal injury, loss, or damage to property arising from the use of the mobile cart.

10. Force Majeure

• Birdy Cart Hire will not be liable for failure to fulfill the hire agreement due to circumstances beyond its reasonable control, including but not limited to extreme weather conditions, accidents, or local government restrictions.

11. Insurance

• The customer is encouraged to arrange their own insurance coverage for the duration of the hire period.
• Birdy Cart Hire does not provide insurance for the cart and will not be responsible for any loss or damage that occurs during the hire period.

12. Governing Law

• These terms and conditions are governed by and construed in accordance with the laws of NSW. Any disputes will be subject to the exclusive jurisdiction of the courts of NSW.
