1. Agreement Overview
These terms govern the hire of mobile carts from Birdy Cart Hire. By making a booking and paying the deposit, you accept these terms. Please read them carefully before booking.
2. Booking & Reservation
- All bookings are made through our website enquiry form or by contacting us directly.
- A deposit of 50% is required at the time of booking to secure the date.
- The balance is due 5 days before the event date.
- Bookings are subject to availability.
3. Last-Minute Bookings
- A last-minute booking is a reservation made within 2 days of the event date.
- Full payment, including any rush fees, is required at the time of booking.
4. Service Period
- The minimum service period is 1 hour. Additional hours are charged at the standard rate.
- The service period starts at the agreed setup time. Any extension on the day must be agreed in writing or by text message.
5. Delivery & Site Access
- Delivery and setup times are confirmed during the booking process.
- The customer is responsible for confirming venue access, parking, and a suitable level surface for the cart.
- We require one standard power point. If unavailable, a generator can be provided for $100.
- If the customer is not present at the agreed delivery or collection time, additional charges may apply.
6. Outdoor Events & Weather
- For outdoor events, the customer is responsible for arranging an undercover area (minimum 1.5m x 1m) as wet weather backup.
- If no backup is available and the event cannot proceed safely, our cancellation policy applies.
7. Final Numbers
- Final guest count and coffee count must be confirmed 7 days before the event.
- Additional cups served on the day above the agreed count may incur extra charges, subject to supply.
8. Use of Mobile Cart
- Our team operates the cart for the full service period. The cart and equipment are not to be operated by customers or guests.
- The customer agrees not to modify or alter the cart in any way.
- Birdy Cart Hire complies with all relevant NSW food safety and health regulations.
9. Customer Responsibilities
- The customer is responsible for the safety of the cart and team while on site.
- Any damage to the cart caused by customers, guests, or venue staff during the service period is the responsibility of the customer.
- For dry hire bookings, the customer is responsible for returning the cart in clean condition.
10. Cancellations & Changes
- More than 14 days before the event: full refund of the deposit, less any costs already incurred (such as custom-printed materials, name stickers, or other personalised items already produced).
- 2 to 14 days before the event: 50% of the total fee is retained.
- Less than 2 days before the event: no refund.
- Changes to the booking (date, time, hours) must be requested at least 7 days in advance and are subject to availability.
11. Insurance & Liability
- Birdy Cart Hire holds Public Liability insurance. A copy of the certificate is available on request.
- The customer is responsible for their own event insurance covering guests, venue, and personal property.
- Birdy Cart Hire is not liable for indirect loss or damage arising from delays, weather, or circumstances outside our reasonable control.
12. Force Majeure
- Birdy Cart Hire will not be liable for failure to perform due to circumstances beyond our reasonable control, including extreme weather, accidents, vehicle breakdown, or government restrictions. Where possible, we will work with the customer to reschedule.
13. Governing Law
- These terms are governed by the laws of NSW, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of NSW.
